#1546              Friedman, Cathy and Mark                           8 Weyman Ln.

Applicants seeks a variance relative to an in-ground pool within the required property line setback.  Property is located at 8 Weyman Ln. and is situated in the Sharon Woods Subdivision.

Board of Health letter dated 01/10/06 read.  Stating no objections.

Conservation Commission letter dated 01/9/06 read.  Stating no objections.

 

Applicants describes plans to add a built in swimming pool.  The Applicant seeks set back relief of 3 ft on one side.  They already have a 7 ft set back but, a 10ft set back is needed. 

 

The Board asked the Applicant why they should grant them relief.  The Applicant stated that they would have more privacy and that is where her children play.  And the side plot is sloped. 

 

The Board asked why couldn’t they move it 3 ft closer to the house.  The Applicant stated that legally it has to be 10 ft away from the house.   The deck is 10 ft. away from the pool.

 

Ron Howard, neighbor Stating he has no objection to the pool in the back yard but, would object to it being on the side.

 

The Board is requesting a new plot plan in order to see the set backs before the grant any relief.

#1545              Omnipoint Holdings, Inc.                               149 East St.

Applicant seeks to collocate it’s wireless communication facility(WCF), within  and at the base of an existing tower located on the property.  Property is located at 149 East St. and is situated in the Single Residence A Zoning District.

Board of Health letter dated 01/1/06 read.  Stating no objections

 

Mauyra Sullivan, Attorney representing Omnipoint Holdings, Inc. (T Mobile)  explained the plans to add two antennas to the existing 140 ft mono pole.  The first antenna is at 117ft and the top antenna will be at 120ft and fully enclosed within the existing pole.  Their  equipment will be at the base of the tower within the existing stockade.fence compound.  There are no propane tanks or generators of any kind.  All the equipment is battery operated back up.

Applicant seeks two findings and a special permit relative to proposed habitable space expansion to a home on a nonconforming lot.  Property is located at 7 Livingston Rd. and is situated in the Rural 2 Zone within the Surface Water District.

Applicant describes plans to enclose the existing deck off the master bedroom to add a sitting room and enlarge the bathroom.  The deck will be raised up to floor level.

 

The existing living space is 3400 sq. ft. and proposed living space is 112 sq. ft.

Applicant seeks two findings and a special permit relative to proposed expansion to a structure on a nonconforming lot.  Property is located at 5 Foxfire Drive and is situated in the Rural 1 Zone within the Groundwater Protection District.

The Board and Applicant reviewed the proposed plans.  

 

Joe Kent’s letter dated 12/16/06 read.  Stating that the setback requirement for this zoning district is still the design standard of the Single Residence B Zone, a standard that requires 30 ft. front and 20 ft side and rear yard setbacks from property lines.

 

Mr. Lisle provided many letters from his neighbors approving the proposed garage/addition designs.

 

Applicant is seeking a 1 ft. setback relief on the sideline were he had 18.7ft  and 19 ft. is needed.  Applicant provided a decision that was precisely granted by this Board in 2001 with similar plans on Foxfire Dr.

 

A revised plot plan was provided.
